Elizabeth Holmes, the disgraced founder of failed blood-testing startup Theranos, has formally requested that President Donald Trump commute her prison sentence, according to documents released by the U.S. Justice Department's Office of the Pardon Attorney.
Commutation Request Filed Under Review
Holmes was convicted of defrauding investors in her now-defunct blood-testing startup that was once valued at $9 billion. The Justice Department's Office of the Pardon Attorney lists the status of her commutation request, which was made last year, as pending.
Holmes, 41, has almost six years left of her sentence after she was convicted of defrauding investors with false claims about her company's blood-testing technology. Holmes' release date is currently Dec. 30, 2031, according to the Federal Bureau of Prisons' website.
The Theranos Fraud and Conviction
Holmes was convicted in 2022 on four counts of wire fraud and conspiracy for cheating investors and was ordered to pay $452 million in restitution. Prosecutors said Holmes lied to investors from 2010 to 2015 by promising Theranos' technology could run many medical tests on one blood drop from a finger prick.
In 2003, Holmes dropped out of Stanford University at 19 to launch Theranos, a company that sought to diagnose a variety of medical conditions with just a pinprick of blood. Theranos swiftly rose to prominence, becoming a darling of Silicon Valley and at one point being valued at more than $9 billion.
Legal Appeals and Restitution Requirements
An appeals court upheld the fraud convictions, sentences and $452 million restitution order for Holmes and her second-in-command, Ramesh "Sunny" Balwani. The three-judge panel for the appeals court rejected their claims, finding that any errors were harmless or that their arguments failed to show any violation.
A key distinction exists between a commutation and a full pardon. If Trump commutes her sentence, she still would owe restitution and remain on probation. Those obligations would not apply if she got a pardon.
Current Prison Conditions and Family Circumstances
Holmes, 41, has two small children and is serving her term at a minimum-security prison camp northwest of Houston. She has asked the judge who sentenced her to knock more than two years off her punishment.
Previously, Holmes has already benefited from sentence reductions through good behavior. Her diligent conduct in prison has contributed to her maintaining a relatively lower security status within the federal system.
White House Response and Broader Clemency Context
The White House said it does not comment on potential clemency requests and that the president is "the final decider" on all pardons or commutations.
The White House is sifting through thousands of clemency requests, including a pardon bid by Archegos Capital Management founder Bill Hwang, who was convicted over the collapse of his $36 billion family office. Last week, Trump granted clemency to more than 20 people, including several convicted of white-collar crimes.
